Membership Agreement

Thank you for reviewing the terms ("Terms" or "Rules") for the VIP Program (the "Program"). These Terms are between You and TOUCHIFY and/or its affiliates ("Us" or “We”) and govern our respective rights and obligations. Your participation in the Program is subject to our Terms & Conditions and Privacy Policy, as well as all other applicable terms, conditions, limitations and requirements. The Terms, together with applicable terms related to any promotional offers provided to you for use with the Program, constitute the entire agreement between You and Us related to the Program. By enrolling, and continuing to use the Program, you accept these terms, conditions, limitations and requirements. We may make changes to these Terms or terminate the Program. If we make material changes or terminate the Program, we will notify you by e-mail and/or post the new terms at https://www.touchify.shop.

 

1. MEMBERSHIP

1.1 Free Membership

No purchase is necessary to earn Points in the VIP Program. To earn Points, simply create an account.

1.2 Eligibility

Membership in the Program is limited to individuals only and is limited to one account per individual. Persons under the age of 18 ("Minors") must obtain their parent’s or legal guardian’s consent prior to participation. By joining the VIP Club, you agree (or, if you are a Minor, your parent or legal guardian agrees) to be bound by these terms and conditions. To enroll in the VIP Club and to be eligible for the Program, you must provide your first name, last name, gender, email address, and date of birth. Each person may have only one VIP Club account.

1.3 Opening an Account

You may apply to become a member of the VIP Club by visiting touchify.shop (the "Website").

1.4 Account Maintenance

Once you are a VIP Club member, you may view a summary of your Account on the Website. After logging onto the Website, simply click LOGIN on the VIP page to view your VIP Rewards Points balance, transaction history, eligibility for bonus offers, and to revise any information on your account.

1.5 Member Cancellation

You may cancel your VIP Club membership at any time. Upon cancellation, any unused Points accrued in your account will be forfeited and cannot be redeemed.

 

2. EARNING POINTS

2.1 General

Members can earn VIP Points on the purchase of qualifying products and/or shares/surveys participation at touchify.shop. To earn Points, you must be a VIP Club Member. You must be signed into your VIP Club account to receive Points for any purchase.

2.2 Earning Points

VIP Members earn one (1) point for every $1 spent on touchify.shop.

Each 100 points earns $10 credit towards any touchify.shop product. You may start redeeming your Reward Points once you have earned 100 Points. Points cannot be shared with any other VIP Club member.

  • Get 1 point for every $1 spent on touchify.shop.
  • When 100 points are earned, you will receive a $10 credit towards any touchify.shop purchase.

Referrals:

VIP Members earn 50 points (value $5 )for each successful referral who makes a purchase.

Your referral gets $5 off coupon to use towards their 1st purchase of $20 or more.

In other words, for every referral, you and your friend can earn a total of $10.

Earn Additional Points:

  • 50 points when you sign up (one-time only)
  • 25 points on your birthday (once per year)
  • 25 points when you leave a related review with photo or video
  • 5 points when you FOLLOW us on Instagram
  • 5 points will be added when you LIKE us on Facebook
  • 5 points when you FOLLOW us on Twitter

2.3 Timing of the Addition of Points to Accounts

VIP Points earned from the purchase of qualifying products will be credited within 72 hours after shipping. The timing for issuing Points is subject to change.

Customers must enter their birthday at least 30 days in advance to be rewarded on birthday.

2.4 Returns

Points earned for a purchase that is then the subject of a return, refund, returned check due to non-sufficient funds, or other credit issue will be deducted from the Member's account in an amount equal to the Points earned for the original transaction, including any bonus Points. If a return will cause your VIP account to have a negative Point balance, a store credit will be issued on the return regardless of your original form of payment.

2.5 Bonus Point Promotions

From time to time, We may run certain bonus Point promotions. Under bonus Point promotions, Members can earn additional or "bonus Points" in connection with the purchase of certain products. When these products are purchased by a Member, the Member will earn bonus Points on each product, as specified in the offer. Bonus Point promotions are subject to the terms and conditions of the offer and may be offered at any time in Our sole discretion. Bonus Point offers cannot be combined with any other offer. You may also earn additional points on non-purchase activities at Our discretion. From time to time, We may offer the chance to win various prizes, including points. There is NO PURCHASE NECESSARY TO PLAY OR TO WIN. Rules and restrictions will apply to such promotions.

2.6  Points Disputes

If you believe that a purchase made on your VIP Club account should have resulted in the addition of Points to your Points balance, and such Points are not reflected in the Points balance of your account within forty-five (45) days of the date on which the purchase posted ("Points Dispute"), notify us immediately. We will use reasonable efforts to investigate your Points Dispute so long as You notify us of a dispute within ninety (90) days of the posting date of the purchase. If You do not notify us within the ninety (90)-day period, You will have waived your right to make a Points Dispute with respect to that purchase. In order for us to undertake an investigation of your Points Dispute, we may require You to provide written confirmation of the dispute. If We do not receive the requested written confirmation at the address and within the time requested by us, We may, in our sole discretion, determine not to investigate your Points Dispute. Upon completion of our investigation of your Points Dispute, we will have no further responsibilities should you later reassert the same Points Dispute.

 

3. REDEEMING POINTS

Points may be redeemed for purchases on touchify.shop products as follows:

  • 100 Points: $10.00
  • 200 Points: $20.00
  • 300 Points: $30.00
  • 400 Points: $40.00
  • 500 Points: $50.00

Must-know details about redeeming reward points: 

  • Due to our website automation, when you redeem reward points you cannot apply/combine any other promos or promo codes to/with that order.
  • Cart total must be double the value of reward points redemption or higher. Reward points can only be redeemed in denominations of $10 or more. i.e.: Reward points cannot exceed half the total value of your cart. For example, if you are using $10 rewards, your cart order must be $20 or more.
  • Make sure you are logged in on the website you originally created an account in order to shop with points.

Points may only be redeemed after you accumulate 100 Points.

The Member is responsible for sales tax and shipping on all products purchased with redeemed Points.

Points accumulated on different VIP Club accounts may not be combined or aggregated. Points earned in a transaction cannot be redeemed in the same transaction.

 

4. REFERRALS

Earn 50 points for each successful referral who makes a purchase.

Your referral gets $5 off coupon to use towards their 1st purchase of $19 or more.

 

    5. GENERAL

    We may, in our discretion, change these Terms and Conditions, including, without limitation, the Point conversion ratio and the Point expiration policy, Conditions of Use or Privacy Policy, or any aspect of Program membership. If any change to these terms is found invalid, void, or for any reason unenforceable, that change is severable and does not affect the validity and enforceability of any remaining changes or conditions. YOUR CONTINUED MEMBERSHIP AFTER WE CHANGE THESE TERMS CONSTITUTES YOUR ACCEPTANCE OF THE CHANGES. IF YOU DO NOT AGREE TO ANY CHANGES, YOU MUST CANCEL YOUR MEMBERSHIP.

    A Member's Point balance, as reflected in our records, shall be deemed correct. 

    We assume no responsibility for errors caused by incorrect Member information.

    The sale of Points is prohibited and may result in the confiscation or cancellation of Your Points as well as suspension or termination of Your Membership, which in each case shall be final and conclusive.

    We may revoke any Member's membership in the Program at any time if the Member engages in abuse of the Program or fails to follow the terms and conditions of the Program. Fraud or abuse relating to the accrual of Points or redemption of rewards may result in revocation of membership in the Program.

    Points are non-transferable and cannot be redeemed for cash.

    All taxes on any Points are the responsibility of the Member.

    The interpretation and application of the Program's Terms and Conditions are at the sole discretion and determination of TOUCHIFY.

     

    6. LIMITATION OF LIABILITY

    In addition to the other limitations and exclusions in the Conditions of Use, in no event will we or our directors, officers, employees, agents or other representatives be liable for any direct, indirect, special, incidental or consequential damages, or any other damages whatsoever arising out of or in connection with the Program. Our total liability, whether in contract, warranty, tort (including negligence) or otherwise, will not exceed the total amount of the eligible purchases that are the subject of the dispute. These exclusions and limitations of liability will apply to the fullest extent permitted by law and will survive cancellation or termination of your membership. The limitations set forth in this section do not limit or exclude liability arising from BEST BUY's gross negligence, willful, intentional, intentional, reckless or malicious misconduct or fraud.

    7. DISPUTE RESOLUTION

    We and You each agree that any dispute resolution proceedings of any nature or in any forum will be conducted only on an individual basis and not in a class, consolidated or representative action. This means that You may not purport to act on behalf of a class or any other person. Likewise, an arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding.

    We and You each waive any right to a jury trial, unless such waiver is unenforceable. This means that any claim would be decided by a judge, not a jury.

    We and You also both agree that You or We may bring suit in court to seek to enjoin infringement or other misuse of intellectual property rights.
